This website is operated by NordicWave s.r.o. Throughout the site, the terms “we”, “us” and “our” refer to NordicWave s.r.o., Rybná 716/24, 110 00 Prague, Czech Republic. NordicWave s.r.o. offers this website, including all information, tools and services available from this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including additional terms, conditions and policies referenced herein. These Terms apply to all users of the site, including browsers, customers, merchants and contributors of content.

If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.

Our store is hosted on Shopify Inc., which provides us with the e-commerce platform that allows us to sell our products and services.

  1. ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are at least 18 years old and of legal age in your country of residence. Our products are strictly intended for adults (18+).

We apply a strict age-verification process. The customer must prove legal age before receiving the first order. If the delivery partner determines that the recipient is underage, delivery will be refused and the shipment returned. In such cases, we reserve the right to charge a flat fee of EUR 25 to cover additional shipping and handling costs, unless the customer proves that no or lower damage was incurred.

You may not use our products for any illegal or unauthorized purpose, nor violate any applicable laws in your jurisdiction.

  1. PRODUCTS – NICOTINE DISCLAIMER

Our products contain nicotine, which is an addictive substance. They are not intended for use by minors, pregnant or breastfeeding women, or persons with cardiovascular diseases or other health conditions that may be affected by nicotine consumption.

Our products are not medical products and are not intended to diagnose, treat, cure or prevent any disease. We sell our products strictly to customers aged +18 and over.

  1. CONTRACT CONCLUSION

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By placing an order, the customer submits a binding offer to purchase the products in the shopping cart. The contract is concluded only when we accept the order by sending an order confirmation or shipping confirmation by email.

  1. PRICES AND TAXES

All prices displayed on the website are final prices and include applicable VAT, unless stated otherwise. Shipping costs are shown separately during the checkout process.

In the case of cross-border deliveries within the EU, different VAT rates may apply depending on the destination country.

  1. PAYMENT TERMS

We accept the payment methods displayed during the checkout process.

Payment processing is carried out via our payment partner Rapyd Payments and NoPayn Payments and, where applicable, other authorized payment service providers. By selecting a payment method, the customer agrees to the terms and conditions of the respective payment service provider. https://www.rapyd.net/

The purchase price is due immediately upon conclusion of the contract. Orders will only be processed after successful authorization of the payment. We reserve the right to cancel an order if payment authorization is unsuccessful or rejected.

  1. DELIVERY AND SHIPPING

Delivery is made to the countries displayed in the shop during checkout. Delivery times are indicated on the product pages or during checkout and may vary depending on the destination country.

For consumer customers, the risk of accidental loss or deterioration of the goods passes to the customer only upon actual delivery of the goods.

  1. RETENTION OF TITLE

The goods remain our property until full payment has been received.

  1. RIGHT OF WITHDRAWAL

Consumers have a statutory right of withdrawal within 14 days.

The right of withdrawal does not apply to sealed goods which are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery, including opened nicotine pouches or snus products.

  1. RETURNS AND REFUNDS

Returns and refunds are only accepted in accordance with our Withdrawal Policy and Return Policy.

We do not guarantee that all information on this site is accurate, complete or current. Product descriptions and images are for informational purposes only.

  1. THIRD-PARTY SERVICES AND LINKS

We may provide access to third-party tools or links. We are not responsible for the content, accuracy or liability of third-party websites or services.

  1. USER COMMENTS AND FEEDBACK

If you submit comments or suggestions, you grant us the right to use, edit and publish them without restriction or compensation.

  1. PROHIBITED USES

You are prohibited from using the site or its content for unlawful purposes, violating applicable laws, infringing intellectual property rights, transmitting malicious code, scraping data, or interfering with security features.

  1. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Our services and products are provided “as is” and “as available”.

We shall be liable without limitation for damages resulting from intent or gross negligence, as well as for injury to life, body or health. In cases of slight negligence, we shall only be liable for the breach of essential contractual obligations, limited to foreseeable damages typical for the contract.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless NordicWave s.r.o. from any claims arising out of your breach of these Terms or violation of law.

  1. TERMINATION

These Terms remain effective unless terminated by either party. We may terminate the contract immediately if you breach these Terms.

  1. GOVERNING LAW

These Terms shall be governed by the laws of the Czech Republic. Mandatory consumer protection laws of the country in which the consumer has their habitual residence remain unaffected.

  1. ONLINE DISPUTE RESOLUTION

The European Commission provides an online dispute resolution platform (ODR). We are not obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.

  1. CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms at any time. The current version is available on this page.
